The legal basis for data protection can be found in the European General Data Protection Regulation (GDPR).

The safety of your personal data is important to us. We collect, use and store your personal data exclusively in accordance with the statutory provisions (DSGVO, DSG, TKG 2003) and do not disclose your data to third parties.

Collection and processing of data

Every access to our website and every retrieval of a file stored on this website are logged. The storage serves internal system-related and statistical purposes. The following are logged: name of the retrieved file, date and time of the retrieval, amount of data transferred, message about successful retrieval, web browser and requesting domain. Additionally, the IP addresses of the requesting computers are logged. Further personal data are only collected if the user of the website voluntarily, for example in the context of a request or registration or to conclude a contract or through the settings of his browser.

The data processing is carried out on the basis of the legal provisions of § 96 (3) TKG and Art. 6 para. 1 lit. a (consent) and / or f (legitimate interest) of the GDPR.

Our concern in the sense of the GDPR (legitimate interest) is the improvement of our offer and our website. Since the privacy of our users is important to us, the user data are pseudonymized. The user data is stored for a max. of 12 months.

Cookies

Our website uses cookies. A cookie is a text file that is sent when you visit a website and stored on the hard drive of the user of the website. If the corresponding server of our website is called again by the user of the website, the browser of the user of the website sends the previously received cookie back to the server. The server can then evaluate the information obtained by this procedure in various ways. Cookies can be used f. e. to facilitate the navigation on a website. Newsletter and MailChimp

You can subscribe to our newsletter via the form on our website (www.awg.at) or via this Link. For this we need your e-mail address and your declaration of consent, that you agree with the subscription to the newsletter.

We use MailChimp as our marketing automation platform. To unsubscribe from the newsletter, you can unsubscribe at any time by clicking on the “unsubscribe” button / “unsubscribe from this list” button in the footer of each mailing or by sending your cancellation to the following e-mail address: datenschutz@awg.at. We will then delete your data, which you have sent us in connection with the newsletter dispatch as soon as possible and at the latest after one month.

Collection and processing of data in the case of an existing contractual relationship with AllesWirdGut

We process the data that you provide to us as a customer for the execution of pre-contractual measures and at the conclusion of the contract.

The data processing is for the following purposes:
Within the framework of our business relationship, the data provided by you are automatically processed (e.g. e-mail traffic, drawing programs) and in the form of archived text documents (e.g. correspondence, contracts, plans, notices, manuals, personalized invoices) in order to carry out pre-contractual measures and fulfill the contract as well as for marketing purposes.

Legal basis of data processing
Data processing is based on Art. 6, 1 lit. b) of the GDPR (contract initiation and fulfillment). In order to complete your order/ your ordered service to your complete satisfaction, we need your data.

In addition, data processing takes place on the basis of Article 6,1 lit. f) of the GDPR (legitimate interest in marketing and advertising) or Article 6, 1) a) (consent). We would like to inform and update you as a current user about our services and projects.

Use and disclosure of the data
We use your data only for the execution of the contract, to answer your inquiries, for accounting and billing purposes and for the technical administration.

We only pass on your personal data if this is necessary for the purpose of contract execution or for billing purposes or if you have given your consent.

Your data will be deleted if your data is no longer required to fulfill the purpose for which it was stored, or if the storage becomes inadmissible for legal reasons. Data for billing purposes and accounting purposes are not affected by a request for cancellation.

Online meetings, conference calls and online seminars

Below we inform you about the processing of personal data in connection with the video and telephone conference tools used by AllesWirdGut:

Purpose of processing
We use the tools GoToMeeting (a part of the services provided by LogMeIn), Jitsi, 3CX and valarea to conduct telephone conferences, online meetings, video conferences and/or webinars (hereinafter: “online meetings”).

Note: If you access the GoToMeeting, Jitsi, 3CX or valarea website, the provider is responsible for data processing. However, it is only necessary to go to the website in order to download the software for using GoToMeeting, Jitsi, 3CX or valarea or – otherwise – to use it online.

Which data are processed?
When using GoToMeeting, Jitsi, 3CX or valarea, different types of data are processed. The scope of the data also depends on what information you provide before or when you participate in an online meeting.

The following personal data are subject to processing:
User information: first name, last name, phone (optional), email address, password (if “single sign-on” is not used), profile picture (optional), department (optional)

Meeting metadata: topic, description (optional), participant IP addresses, device/hardware information

For recordings (optional): MP4 file of all video, audio and presentation recordings, M4A-file of all audio recordings, text file of online meeting chat.

When dialing in with the telephone: information on the incoming and outgoing phone number, country name, start and end time. If necessary, further connection data such as e.g. the IP address of the device can be saved.

Text, audio and video data: You may have the option of using the chat, question or survey functions in an online meeting. In this respect, the text you enter will be processed in order to display it in the online meeting and, if necessary, will also be recorded. In order to enable the display of video and the playback of audio, the data from the microphone of your end device and from any video camera on the end device are processed accordingly for the duration of the meeting. You can switch off or mute the camera or microphone yourself at any time via the “GoToMeeting, Jitsi, 3CX and valarea” applications.
In order to take part in an online meeting or to enter the “meeting room”, you must at least provide information about your name. However, this can be pseudonymised in the settings.

Scope of processing
We use “GoToMeeting, Jitsi, 3CX and valarea” to conduct online meetings. If we want to record, we will inform you transparently in advance and ask for your consent. The fact of the recording is also displayed in the app.
If necessary for the purposes of logging results of an online meeting, we will log the chat content.
In the case of online seminars, we may also process the questions asked by online seminar participants for the purpose of recording and following up on webinars.
If you are registered as a user with “GoToMeeting, Jitsi, 3CX or valarea”, reports on online meetings (meeting metadata, telephone dial-in data, questions and answers in webinars, survey function in webinars) can be stored for up to one month.

Legal base of data processing
Otherwise, the legal basis for data processing when conducting online meetings is Art. 6, 1 lit. b) GDPR, if the meetings are held within the framework of contractual relationships.
If there is no contractual relationship, the legal basis is Art. 6, 1 lit. f) GDPR. Here, too, we are interested in the effective implementation of online meetings.

Recipients/ disclosure of data
Personal data processed in connection with participation in online meetings are generally not passed on to third parties unless they are intended and/or permitted to be passed on.
Other recipients: The provider necessarily receives knowledge of the above data, if this is part of or stands in the context of our data processing agreement.

Data processing outside the European Union
“GoToMeeting and Jitsi” are services provided by providers located in the United States. Processing of the personal data also takes place in a third country. We have concluded a data processing agreement with the provider that meets the requirements of Art. 28 GDPR.
An appropriate level of data protection is guaranteed by the conclusion of the so-called EU standard contractual clauses.

Recording of “online meetings” and “presence meetings”
The default settings in GoToMeeting, Jitsi, 3CX or valarea are defined so that no automatic recording takes place. The fact of recording is indicated to the participants in GoToMeeting, Jitsi, 3CX or valarea by a red record symbol. In order to protect copyrights and in particular the personal rights of our employees, we exclude the possibility of any recording of online meetings and “presence meetings”. In exceptional cases – defined before a meeting takes place – a recording may only be made with the explicit consent of all participants concerned and only to the extent that this is necessary for official purposes or for the specific fulfillment of tasks. The recording person must obtain the consent of all participants in advance.

You have the right of information, correction, deletion, limitation of processing, data portability, revocation and opposition. It is possible that we ask you for proof of identity for processing the request.

If you believe that the processing of your data violates data protection law or if your data protection claims have been infringed in another way, you can complain to the supervisory authority. In Austria and Germany this is the data protection authority of the respective country.
